Q: Can this just rest on the rear fender side instead of the seat?

It can but consider that the fender is smooth, and the bag could slip. Be sure to occasionally stop and check the bag position and stability. Also, when riding you may find that road grit may get caught between the bag and fender, causing scratches. I've done it all. I suggest you mount it on a rack rather than a barely fender. You can also wear the bag like a backpack, though it is heavier/sturdier than some similar size backpacks. I'm happy with my Kuryakin Momentum Freeloader
